The Indian Parliament Passed The Consumer Protection Act Of 1986 (Copra), Which Took Effective In December 1986. This Act Was Passed For The Purpose Of Safeguarding Consumers, By Establishing State Organs For The Consumers' Problems And Any Occurrence As A Result Of Them.


The Consumer Courts Are Courts, Which Are Also Called Consumer Dispute Resolution Agencies, Dealing In Consumer Disputes, Conflicts, Or Grievances.  This Is A Venue Where A Consumer Can Submit A Case Against A Merchant Who Has Misled Or Exploited Them. The Whole Idea Of Providing A Separate Forum For These Types Of Disputes Is To Ensure Expeditious Justice And Inexpensive Justice.


Types Of Consumer Courts


The Consumer Protection Act Of 2019 In India Establishes The Consumer Courts At Three Levels—The National Level, The State Level, And The District Level, the First Two Of Which Are Popularly Also Known As Consumer Forums Or Consumer Dispute Resolution Commissions.


  • National Consumer Disputes Redressal Commission (Ncdrc): It Is The Apex Consumer Court In India Established In 1988 And The Ncdrc Is Located At New Delhi. It Hears Appeals Against Decisions Made By State Consumer Commissions And Deals With Complaints Whose Claims Exceed Rs. 1 Crore.

  • State Consumer Disputes Redressal Commission (Scdrc): Every State In India Has Its Governing Scdrc That Works As The Second-Highest Consumer Court. It Also Hears Appeals Against Decisions Made By The District Consumer Forum And Deals With Specified Complaints Where Claims Range From Rs. 20 Lakhs To Rs. 1 Crore.

  • District Consumer Disputes Redressal Forum (Dcdrf): The Dcdrf Has Been Established In Every District In India. It Is The Lowest Tier In The Hierarchy Of Consumer Courts. The Dcdrf Looks Into Situations When The Value Of Goods Or Services And The Compensation Sought Are Less Than Rs. 20 Lakh.


Steps To Resolve Disputes With Service Providers In Consumer Court


  • The Aggrieved Party Should Give A Notice To The Service Provider Who Rendered Goods Or Services. The Notice Shows The Complainant's Intention To File A Lawsuit And Informs Him Of The Flaws In Goods/Services Or Unfair Activity.  The Notice Attempts To Resolve The Grievance Without Moving The Forum, I.E., If The Service Provider Would Be Willing To Pay Compensation Or Some Other Remedy.

  • If The Service Provider Does Not Offer Any Compensation Or Other Remedy, A Formal Complaint Has To Be Filed Under The Consumer Protection Act, 1986. There Need Not Be A Lawyer For Filing The Complaint. The Aggrieved Person Can File The Complaint.

A) A Bill And Delivery Receipts, As Well As Packaging Of The Product And An Online Booking Record For Goods Purchased

B) Warranty/Guarantee Certificates

  • Select The Correct Forum For Filing Your Suit Complaint Based On The Pecuniary Jurisdiction, Which Can Be Estimated As The Total Value Of The Goods and Services That Have Been Bought Or Availed And The Amount Of Compensation Requested.

  • The Prescribed Fee In Order To File A Complaint Will Depend Upon The Forum Where It Is Placed. The Court Fee, Depending On The Value Of Goods Purchased And The Amount Of Compensation Claimed, Shall Vary.

  • The Person Intending To File A Case In Consumer Court Shall Submit An Affidavit Before The Court. Such Affidavit Shall Be To The Effect That The Facts Presented And Statements Made By The Consumer Are True To His Knowledge.
