Various Remedies, Such As Restitution Of Conjugal Rights, Annulment, Or Divorce, Result From These Issues, Which Include Desertion Of The Spouse For A Continuous Period Of Two Years, Withdrawal From The Other's Society Without Reasonable Cause, And Mental Illness At The Time Of Marriage.


  • The Legal Process For Ending A Marriage Is Called A Divorce. A Couple Or One Of The Parties May Petition The Court For A Divorce If They Believe Their Marriage Is Over Due To Adultery, Bigamy, Desertion, Or Other Reasons Listed In The Act.

  • Annulment: There Must Be Specific Reasons For Any Spouse To File For The Annulment Of The Marriage. Through This Process, A Marriage Is Deemed To Have Never Happened At All, Rendering It Void. An Annulment Has Not Been Granted As A Remedy In Many Cases, And It Is Typically Difficult To Prove.

  • Restitution Of Conjugal Rights: The Injured Party May Petition The Court For The Restoration Of Marital Rights If One Partner Has Left The Other's Society Without A Good Reason. By Doing This, The Couple's Rights Resulting From Their Marriage Are Upheld. The Defendant Would Be Expected To Explain The "Reasonable Cause" Defense To The Court.


Maintenance In Hindu Law


In That It Follows Relief Such As Divorce, Custody, Or The Redress Of Domestic Abuse, Rather Than Existing On Its Own, Maintenance Is Considered An Ancillary Relief. The Wife Has The Unalienable Right To Maintenance From Her Husband Under Hindu Law. 


However, If She Veers Off The Straight And Narrow, She Forfeits Her Right. The Hindu Adoption And Maintenance Act, Of 1956, Guarantees Her The Right To Maintenance. The Husband's Position And Liabilities Are Just A Couple Of The Factors The Court Considers When Determining The Amount Of Maintenance. It Also Determines If The Wife's Separation From Her Husband Is Appropriate. The Act's Specified Reasons Determine What Is "Justifiable."


If One Spouse Lacks An Independent Source Of Income To Support Themselves, The Other Will Be Responsible For Paying Maintenance Pendente Lite (Pending The Suit) And Even The Costs Associated With A Matrimonial Lawsuit. The Payment Of Ongoing Maintenance Will Be Governed By The Same Principle.
